If you use a tax agent, you probably\nwon\u2019t have to lodge this year\u2019s income tax return until March 2021. How likely\nis it that you will remember everything you did and all the purchases you made in\nMarch 2020, one year from now? Unlikely right. Therefore, its best to start\nkeeping records now.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Expenses you may be entitled to claim <\/h3>\n\n\n\n<p>Here\u2019s a list of expenses you can typically claim. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Running costs <\/h4>\n\n\n\n<p>These expenses include heating, cooling, lighting, cleaning,\nand so on. There are two methods you can use to calculate this deduction: <\/p>\n\n\n\n<ol><li>Fixed\nrate &#8211; You can claim a deduction of 52 cents for each hour you work from home\ninstead of recording all of your actual expenses for heating, cooling,\nlighting, cleaning and the decline in value of furniture. You can either keep a\nrecord of the number of hours you have worked from home during the coronavirus\nperiod. Or, if you regularly work from home, you can keep a diary for a representative\n4 weeks; or<\/li><li>Actual\ncosts \u2013 You can use this method if you have a dedicated workspace and you can\naccurately apportion costs such as power, heating, cleaning and depreciation.\nYou still need to keep a 4-week diary or actual record of hours worked to\nsupport your calculations. <\/li><\/ol>\n\n\n\n<p>Obviously, for most people, the fixed rate option is the simplest. More information is available on the ATO\u2019s website <a href=\"https:\/\/www.ato.gov.au\/Individuals\/Income-and-deductions\/Deductions-you-can-claim\/Home-office-expenses\/#runningexp\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">here<\/a>. &nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Consumables <\/h4>\n\n\n\n<p>Items such as software subscriptions, stationery, paper\nfor your printer and printer ink can be tax deductible. You must retain\nreceipts as evidence. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Mobile phone &amp; internet expenses <\/h4>\n\n\n\n<p>There are two methods available to use to determine your\ntax deduction for mobile phone usage: <\/p>\n\n\n\n<ol><li>A\ntotal deduction of $50 with limited documentation required. This method is\nappropriate when your device usage is incidental; or <\/li><li>Claim\na proportion of actual expenses. To work out the actual work-related proportion,\nyou need to consider the amount of usage solely for work compared to the\noverall usage. Usage could include functions such as voice calls, text\nmessages, data and app usage. You need to keep a diary for a representative\nfour-week period to support your claim. <\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\">Computer and office equipment <\/h4>\n\n\n\n<p>If the cost of the equipment is less than $300, then you\ncan claim a full deduction in the financial year the purchase was made. If the\nequipment costs more than $300, you must depreciate the item over its useful\nlife. Note, if any equipment purchased is partially used for private use\npurposes, you will need to apportion the depreciation for its work use\npercentage.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Expenses you may not be entitled to claim <\/h3>\n\n\n\n<p>Here is a list of expenses that you are not able to\nclaim.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Rental expense or mortgage interest (occupancy expenses) <\/h4>\n\n\n\n<p>Generally, you cannot claim a deduction for interest cost or rent paid in respect to a home office. However, if a dedicated portion of your home is your principal workplace, then you can claim a portion of occupancy expenses. Generally, you would apportion the work-related and non-work-related expenses by floor area. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Travel between home and work <\/h4>\n\n\n\n<p>Generally, you are not entitled to claim a deduction for\nthe cost of travel between work and your home office e.g. if you need to go\ninto the office to collect items. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Certain government expenses<\/h4>\n\n\n\n<p>If you were to make a claim using the actual method, you\ncannot claim items such as council rates, land tax and water rates. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Reimbursements<\/h4>\n\n\n\n<p>If your expenses are reimbursed by your employer, you\nwill not be able to claim these work-related expenses. However, if your\nemployer has paid you an allowance for work related expenses, you can claim a\ndeduction against this allowance. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">No capital gains tax<\/h3>\n\n\n\n<p>In most cases, there are no Capital Gains Tax (CGT)\nconsequences of running a home office. <\/p>\n\n\n\n<p>Generally, if you use your home for an income generating\/business purpose, you would normally only be entitled to a portion of the main residence CGT exemption. That is, you wouldn\u2019t be entitled to a 100% exemption. This is true if you claim occupancy expenses. However, if you do not claim occupancy expenses, then you would obtain the full main residence CGT relief. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The ATO\u2019s Golden Rules<\/h3>\n\n\n\n<p>The ATO has provided three rules in determining whether the\ndeduction your claiming is eligible:<\/p>\n\n\n\n<ol><li>The taxpayer must have\nincurred the expense themselves \u2013 and not have been reimbursed.<\/li><li>The expense must be\nincurred in gaining or producing assessable income.<\/li><li>The claim must comply with\nthe substantiation rules \u2013 i.e. all records must be kept.<\/li><\/ol>\n\n\n\n<p>Remember, the onus of proof is on the taxpayer. It is important to know what you\u2019re eligible to claim before lodging your tax return. Don\u2019t be too aggressive just to save a couple of dollars in tax \u2013 it\u2019s not worth the risk of attracting an audit. <\/p>\n\n\n\n<p>The risk of denied tax deductions falls on the taxpayer, not their accountant.  <a rel=\"noreferrer noopener\" href=\"https:\/\/wealthcoach.com.au\/stage\/property-investor-tax-ato\/\" target=\"_blank\">This blog<\/a> tells you more about how the ATO is auditing these matters.
